KSW’s Disputes Practice Group offers our clients vast experience and success in dispute resolution, including mediation, arbitration, and litigation, as well as the direct defense of insured and uninsured entities.
Our aim is to resolve disputes in a zealous but efficient and cost-effective manner, providing our clients with clear advice tailored to the specific circumstances of the case and our clients’ best interests, with common goals and agreed upon benchmarks. KSW counsels clients on alternatives to litigation and is experienced and prepared to handle all aspects of disputes, from attempted pre-litigation mediation or informal resolutions, to the early stages of discovery, through trial, and the appellate process.

KSW has handled simple and complex commercial litigation as part of its practice of representing insurers in state and federal courts around the United States and federal and state agencies. In addition to relatively

“standard” coverage disputes, we have resolved matters involving bad faith allegations against our clients, subrogation issues, and declaratory judgment actions.
In its direct defense of insured and uninsured entities, KSW’s attorneys represent clients in the areas of general liability, professional liability, employment practices, miscellaneous errors and omissions, D&O, and other areas. KSW has also represented businesses and individuals in various commercial contractual disputes. We have had great success representing clients with regard to disputes arising from broker and intermediary relationships, as well as issues involving managing general agents, managing general underwriters, and other delegated authority businesses.
